ELIGIBILITY:

CONTEST DATES:
The contest begins 11/15/04 and ends 12/31/04. We begin counting posts eligible for the Spirit Award Bonus on 10/30/04.

PRIZES (Available to All Affiliates):

$1,000.00 - Grand Prize: The affiliate with the highest total commission earned between 11/15/04 – 12/31/04 is our Grand Prize Winner! To be eligible to win the Grand Prize an affiliate must achieve at least $4,000.00 in commission during the run of the contest. If no affiliate reaches this goal, then the affiliate with the highest total commission will receive a percentage of the $1,000 grand prize based on how close they are to reaching the $4,000.00 goal (i.e., a leading affiliate with $2,000 total commission would win a $500 grand prize).

$100.00 - Early Bird Bonus: The affiliate with the highest commission total between the dates of 11/15/04 – 11/21/04 will win $100.

$100.00 – Veteran Bonus: The veteran affiliate who increases their total commission by the greatest dollar amount will win $100.00 (11/15/03 – 12/31/03 compared to 11/15/04 – 12/31/04). The affiliate must have made at least one sale between 11/15/03 – 12/31/03).

$100.00 – Newbie Bonus: The new affiliate with the highest commission total between the dates of 11/15/04 – 12/31/04 will win $100.00. The affiliate must have signed up with our program in 2004.

$100.00 - Spirit Award Bonus: The affiliate contributing the greatest number of posts to our Dedicated Affiliate Support Forum on A Best Web between 10/30/04 – 12/15/04 will win $100. Only posts to topics started 9/04 and after are eligible. Affiliates posting a lot of gobbly gook and nonsense will be disqualified from this bonus prize. UrbanScooters.com will determine what’s considered gobbly gook and nonsense.

$100.00 - Top 5 Brand Name Keyword Bonus: The first affiliate to rank a keyword related to every brand name** we carry in the top five on Google or twice in the top ten on Google.

$100.00 - #1 Brand Name Keyword Bonus: The first affiliate to rank a keyword related to every brand name** we carry in the #1 position on Google or twice in the top five on Google.

$100.00 - Top 10 Product Keyword Bonus: The first affiliate to rank a keyword related to each scooter model*** we carry in the top ten on Google.

$100.00 - Top 5 Product Keyword Bonus: The first affiliate to rank a keyword related to each scooter model*** we carry in the top five on Google or twice in the top ten on Google.

$100.00 - #1 Product Keyword Bonus: The first affiliate to rank a keyword related to each scooter model*** we carry in the #1 position on Google or twice in the top five on Google.

* To be eligible for the exclusive UrbanScooters.com bonuses, an affiliate must not own or operate ANY website engaged in an affiliate program that actively links to web pages of competitors to UrbanScooters.com that promote the sale of the following brand name electric scooters, gas scooters, electric bikes or pocket bikes (or clones of these brands... clones are cheap look-a-likes of brand name scooters); Boreem, Currie, Freedom, Go-Ped, GT, LashOut, Mongoose, Mosquito, Rad2Go, Schwinn or Viza at any time during the duration of the contest. Affiliates not abiding by this guideline will be disqualified from winning these prizes and any prizes given will be revoked.

On the Brand Name and Product Keyword Bonuses where an affiliate is allowed to rank a keyword twice in the top ten or top five to qualify, the two rankings can be for different eligible variations of the brand name or product keyword. For example; ranking “Rad 2 Go” and “Rad2Go electric scooters” would qualify as successfully ranking that brand name.

NOTIFICATION AND AWARDING PRIZES:

UrbanScooters.com will determine the winner of the following prizes shortly after the end of the contest; Grand Prize, Veteran Bonus, Newbie Bonus, Wild Card Bonus and Spirit Award Bonus.

UrbanScooters.com will determine the winner of the Early Bird Bonus shortly after 11/21/04.

Winners of the Brand Name Keyword Bonuses and the Product Keyword Bonuses will be determined as follows;

Affiliates who feel they qualify for these bonuses will notify UrbanScooters.com by email through their account with Shareasale. The notification email will include the bonus they feel they qualify for and the specific keywords that make them eligible.

The first affiliate to provide proof of qualification for a bonus will be awarded the prize. The first day affiliates will be considered for these bonuses is 11/27/04. All notification emails received on or before that day will be considered equally. In the event of a tie, the affiliate with the greatest number of ranked Brand Name or Product keywords in each category will be the winner.

Keyword rankings will be verified on UrbanScooters.com company computers according to results obtained from www.google.com. The results generated from Google are from keywords entered without quotation marks.

Each prize winner will be notified personally. A general announcement of prize winners will be made available by newsletter and through our Dedicated Affiliate Support Forum on A Best Web. To respect privacy, we will not mention affiliate names publicly in relation to this contest, unless the affiliate gives us permission to do so or reveals themselves in our affiliate forum.


Cash prizes will be awarded through your account with Shareasale.

RESTRICTIONS:

Reaching Google rankings by using hidden text, hidden links, cloaking, sneaky redirects or meta refresh will be grounds for disqualification and the forfeit of all prizes.

Affiliates must be in compliance with the terms of UrbanScooters.com’s affiliate agreement and Shareasale’s affiliate agreement to be eligible to claim prizes in this contest.

If a winner is located outside of the continental United States, they will receive the cash value of their prize and not be eligible to purchase merchandise from UrbanScooters.com at a 25% discount.

Federal, state and local taxes are the responsibility of the winners.

DISPUTES:

Entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this contest, other than the administration of the contest, shall be resolved individually, without resort to any form of class action, and exclusively by a court having competent jurisdiction located in Los Angeles County, California, U.S.A.; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this promotion but in no event attorneys' fees; and (c) under no circumstances will registrant be permitted to obtain awards for, and registrant hereby waives all rights to, claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and UrbanScooters.com in connection with the promotion, shall be governed by, and construed in accordance with, the laws of the State of California, U.S.A., without giving effect to any choice of law or conflict of law rules.

All winners, by acceptance of prize, agree to release UrbanScooters.com from any liability, claims or actions of any kind whatsoever for injuries, damages, or losses of any kind to persons and property which may be sustained in connection with the receipt or use of prize.

UrbanScooters.com reserves the right to disqualify any contestant in the event that any of these contest rules are not met.

Decisions by UrbanScooters.com regarding winner and all contest details are final and binding in all respects.

If any portion of the above rules is determined to be unenforceable due to local or state laws, all other portions of these official rules shall remain in effect.

UrbanScooters.com retains the right to amend these rules and regulations at any time for any reason.
